Terms of Service & End User License Agreement (EULA)

This End User License Agreement (“Agreement”) is a legally binding contract between you (“User,” “you,” or “your”) and BestBytes AI LLC (“Company,” “we,” “our,” or “us”). By accessing, installing, or using PeerLLM Chat or any related services (collectively, the “Service”), you agree to be bound by this Agreement. If you do not agree, you must not use the Service.

1. License Grant

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for lawful, personal, or authorized business purposes in accordance with this Agreement.

2. Prohibited Use and Safety Policy

You must not use the Service to:

• Engage in or promote any unlawful, harmful, fraudulent, or deceptive activity.
• Generate, request, or distribute content involving or instructing:
  • Self-harm, suicide, or injury to yourself or others;
  • Violence, abuse, terrorism, or weapons of any kind;
  • Child exploitation, sexual abuse, or non-consensual acts;
  • Illegal drugs, trafficking, hacking, or criminal acts;
  • Instructions for creating or using weapons, explosives, or hazardous substances.
• Submit or transmit defamatory, obscene, harassing, or infringing material.
• Rely on the Service for legal, medical, financial, or safety-critical advice.
• Reverse engineer, decompile, copy, or otherwise interfere with the Service.
• Use the Service in a way that could impair its availability, integrity, performance, or security.
• Circumvent or disable any moderation, safety, or access controls.

We may monitor, filter, or block content and suspend or terminate access at our discretion if we believe activity violates this Agreement or applicable law.

3. AI Content Disclaimer

The Service generates outputs using artificial intelligence systems that operate autonomously and may respond unpredictably. Such outputs may be inaccurate, misleading, offensive, unsafe, or inappropriate. The Company makes no representation or warranty regarding the accuracy, reliability, legality, or suitability of AI-generated content. You are solely responsible for reviewing and using any output. The Company does not endorse, condone, or assume liability for any content generated by the AI.

The Service does not provide professional, medical, legal, or safety-critical advice, and any reliance on AI outputs is at your own risk.

4. User Responsibilities and Indemnity

• You use the Service entirely at your own risk.
• You must not provide confidential, sensitive, or personally identifiable information within the Service.
• You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations.
• You agree to indemnify, defend, and hold harmless BestBytes AI, its affiliates, officers, employees, contractors, and partners from and against any and all claims, losses, damages, liabilities, costs, or expenses (including attorney fees) arising out of or related to:
  • Your use or misuse of the Service;
  • Any breach of this Agreement;
  • Any violation of applicable laws or third-party rights.

5. Moderation and Enforcement

The Service employs automated and human moderation systems to detect, limit, or block harmful or illegal activity. We reserve the right to log, review, and restrict usage for safety and compliance. However, we do not guarantee detection or prevention of prohibited behavior. We may suspend, delete, or permanently terminate access to any user or content at any time, with or without notice.

6. Privacy and Data

Use of the Service is governed by our Privacy Policy. We may collect limited technical and usage data for functionality, security, and compliance purposes. You consent to lawful processing of this data as described in that policy. Do not share personal, confidential, or sensitive information through the Service.

7. Intellectual Property

All intellectual property, software, trademarks, logos, algorithms, and content associated with the Service are the exclusive property of BestBytes AI LLC. You may use AI-generated outputs for lawful purposes, but you acquire no ownership or rights in the underlying models, systems, or training data.

8. Termination and Suspension

We may suspend or terminate your access to the Service at any time, without notice or liability, for any reason, including violation of this Agreement, harmful conduct, or system misuse. Upon termination, your license to use the Service immediately ceases.

9. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE” without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, availability, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by law:

• BestBytes AI and its affiliates shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages of any kind, including data loss, system downtime, or reputational harm, even if advised of the possibility of such damages.
• Our total liability for any claim arising from or related to the Service shall not exceed the greater of (a) USD $100 or (b) the total amount you paid, if any, for the Service in the preceding twelve (12) months.

Some jurisdictions do not allow certain limitations or exclusions of liability; in such cases, our liability shall be limited to the maximum extent permitted by law.

11. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts located in King County, Washington, and you consent to their personal and subject-matter jurisdiction. Users outside the United States are responsible for ensuring their use complies with local laws.

12. Changes to the Agreement

We may revise or update this Agreement at any time by posting an updated version at https://peerllm.com/terms. Continued use of the Service after such posting constitutes acceptance of the revised Terms.

13. Severability and Entire Agreement

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and BestBytes AI LLC regarding the Service and supersedes all prior or contemporaneous communications.
